In the Safe Streets Act of 1968, Congress determined "To assist state and local governments in reducing the incidence of crime."

This year I am proposing that the Congress provide the full $300 million that the Congress last year authorized to do just that.

I hope the Congress will put the money where the authorization is.

I believe this is an essential contribution to justice and to public order in the United States. I hope these grants can be made to the States and they can be used effectively to reduce the crime rate in this country.

But all of this is only a small part of the total effort that must be made--I think chiefly by the local governments throughout the Nation--if we expect to reduce the toll of crime that we all detest.

Frankly, as I leave the Office of the Presidency, one of my greatest disappointments is our failure to secure passage of a licensing and registration act for firearms. I think if we had passed that act, it would have reduced the incidence of crime. I believe that the Congress should adopt such a law, and I hope that it will at a not too distant date.

The Violent Crime Control and Law Enforcement Act (VCCLEA; also known as the Biden Crime Law) was an act of Congress dealing with crime and law enforcement that became law in 1994. It is the largest crime bill in the history of the US and will provide for 100,000 new police officers, $9.7 billion in funding for prisons and $6.1 billion in funding for prevention programs which were designed with significant input from experienced police officers. [1] Sponsored by U.S. Representative Jack Brooks of Texas, the bill was passed by Congress and signed into law by President Bill Clinton.

Following the 101 California Street shootings and other high-profile instances of violent crime, the act expanded federal law in several ways. One of the most noted sections was the Federal Assault Weapons Ban. Other parts of the act provided for a greatly expanded federal death penalty, new classes of individuals banned from possessing firearms, and a variety of new crimes defined in statutes relating to immigration law, hate crimes, sex crimes, and gang-related crime.

The Domestic Violence Offender Gun Ban (1996) was an amendment to the Omnibus Consolidated Appropriations Act of 1997 which was passed by the 104th US Congress in the Fall of 1996. Officially known as 'Gun Ban for Individuals Convicted of a Misdemeanor Crime of Domestic Violence' -- 18 U.S.C. § 922(g)(9)'[1], 'Public Law 104-208'[2] and is often referred to as the Lautenberg Amendment after its sponsor, Frank Lautenberg.

The Lautenberg Act conflicts with State Laws that are in effect that do not impose a statute under federal law, and or state laws preventing persons from owning a firearm, ammunition, or possessing of such items.

In Example: A person convicted of Domestic Violene in Texas is charged with and convicted of a Misdemeanor Charge Class A. A person convicted of Domestic Violence in very few other states Domestic Violence is charged as a felony.

In all states a violation of a protective order, as well as any other act of Domestic Violence while a protective order is in place is Considered a Felony and the Charges that were initially filed will automatically become a felony charge of Domestic Violence.

The Lautenberg Amendment and or Act does not specify to whether or not a Felony Conviction of Domestic Violence whether by plea, or by Deferred Adjudication or a Misdemeanor Charge of Domestic Violence should fall under the act.

The Lautenberg Amendment excludes all persons convicted of any type of Domestic Violence, or the Subject of a Magistrates Protective order from owning or possessing any type of Firearm, Ammunition, and or other types of weapons that involve a projectile device.

The nation's police forces are up in arms over a new federal gun control law that could strip thousands of them of their guns and jobs. Most police organizations have enthusiastically supported every gun control scheme President Clinton has put forward. Few Americans realized that such legislation almost always contained an exemption for the policemen themselves regarding their official duties. But poetic justice may finally have arrived. Unfortunately, its arrival also heralds the decimation of constitutional rights of a million or more other Americans.

Last September 28, as part of a massive appropriations bill, Congress passed the so-called Lautenberg Act, which greatly increases the number of Americans prohibited by federal law from owning firearms. For the first time, thanks to an amendment by Georgia's Rep. Bob Barr, law-enforcement officials are not exempt from the nation's gun control laws.

The Lautenberg Act prohibits anyone from owning a gun or possessing any ammunition who has ever been convicted of a misdemeanor involving the use or attempted use of physical force or the threatened use of a deadly weapon against a spouse, child, or intimate partner. (People with any felony conviction have been prohibited from owning guns since 1968.) Any person with such a misdemeanor on his record who is found in possession of a gun or even of a single bullet can face a $250,000 fine and 10 years in prison — longer than the average convicted murderer serves in this country.

Gerald Arenberg, executive director of the National Association of Chiefs of Police, observed that the act "has thrown the whole world into confusion for cops." Victor Kappeler, director of the Criminal Justice Graduate Program at Eastern Kentucky University, estimated that if accurate reporting of all such police domestic violence occurred, and if all such assaults were fully prosecuted, 10% of the nation's law-enforcement officials (70,000 individuals) could be found guilty and thus banned from possessing a firearm under the new law.

If were left our to our local government; what restrictions to expect see as firearm owners and our lawful rights, under the Obama opinion ?

Oddly enough; Obama is not alone in voicing his opinion of the Second Amendment. Although our own Representatives, which elected to serve this county, they also have similar views about the second amendment, do own our Board of County Commissioners, The County Chief Police, Our State Representatives, Our Court System, and many more.

While their busy creating more restrictions the for law abiding citizen obey and conform to, and criminals which go about wreaking havoc and chaos with no respect for the law, I can't help thinking we are getting a step closer a toward dictatorship in the nation.

Q: Is the D.C. law prohibiting ownership of handguns consistent with an individual's right to bear arms?

A: As a general principle, I believe that the Constitution confers an individual right to bear arms. But just because you have an individual right does not mean that the state or local government can't constrain the exercise of that right, in the same way that we have a right to private property but local governments can establish zoning ordinances that determine how you can use it.

Q: But do you still favor the registration & licensing of guns?

A: I think we can provide common-sense approaches to the issue of illegal guns that are ending up on the streets. We can make sure that criminals don't have guns in their hands. We can make certain that those who are mentally deranged are not getting a hold of handguns. We can trace guns that have been used in crimes to unscrupulous gun dealers that may be selling to straw purchasers and dumping them on the streets.

MILWAUKEE (AP) - Barack Obama said Friday that the country must do "whatever it takes" to eradicate gun violence following a campus shooting in his home state, but he believes in an individual's right to bear arms.

"I think there is an individual right to bear arms, but it's subject to commonsense regulation" like background checks, he said during a news conference.

He said he would support federal legislation based on a California law that would facilitate immediate tracing of bullets used in a crime. He said even though the California law was passed over the strong objection of the National Rifle Association, he thinks it's the type of law that gun owners and crime victims can get behind.

The Democrats are constantly waging war on the Second Amendment of our Constitution, they do in a manner which defies all logic and reason. Many are coming around to learning the facts behind the myths that the gun control ( people control ) lobbyists have created.

Many of our state elected officials in this county have voted against laws regarding our rights to defend ourselves, in the face of criminal attacks. Our Bill Of Rights is as much part of our lives as the air we breath and our right to exist. There should be no issues concerning our rights, nor should there be a misunderstanding of the definition of those rights. If we lose any portion of those rights, as a nation, we lose our country. I'm not beating the same old drum on this; The Democrats have drawn up a new Assault Weapons Ban which would ban almost every privately owned firearm in this country.

There are International Gun Ban Lobbyists who are pushing a global treaty to ban the private ownership of firearms world wide; They call it the U.N Gun Ban.

Mrs. MCCARTHY of New York introduced the following bill; which was referred to the Committee on the Judiciary

A BILL

To reauthorize the assault weapons ban, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Assault Weapons Ban and Law Enforcement Protection Act of 2007'.

SEC. 2. REINSTATEMENT FOR 10 YEARS OF REPEALED CRIMINAL PROVISIONS RELATING TO ASSAULT WEAPONS AND LARGE CAPACITY AMMUNITION FEEDING DEVICES.

(a) Reinstatement of Provisions Wholly Repealed- Paragraphs (30) and (31) of section 921(a), subsections (v) and (w) and Appendix A of section 922, and the last 2 sentences of section 923(i) of title 18, United States Code, as in effect just before the repeal made by section 110105(2) of the Violent Crime Control and Law Enforcement Act of 1994, are hereby enacted into law.

(b) Reinstatement of Provisions Partially Repealed- Section 924 of title 18, United States Code, is amended--

(1) in subsection (a)(1), by striking subparagraph (B) and inserting the following:

`(B) knowingly violates subsection (a)(4), (f), (k), (r), (v), or (w) of section 922;'; and

(2) in subsection (c)(1)(B), by striking clause (i) and inserting the following:

`(i) is a short-barreled rifle, short-barreled shotgun, or semiautomatic assault weapon, the person shall be sentenced to a term of imprisonment of not less than 10 years; or'.

SEC. 3. DEFINITIONS.

(a) In General- Section 921(a)(30) of title 18, United States Code, as added by section 2(a) of this Act, is amended to read as follows:

`(30) The term `semiautomatic assault weapon' means any of the following:

`(A) The following rifles or copies or duplicates thereof:

`(i) AK, AKM, AKS, AK-47, AK-74, ARM, MAK90, Misr, NHM 90, NHM 91, SA 85, SA 93, VEPR;

`(ii) AR-10;

`(iii) AR-15, Bushmaster XM15, Armalite M15, or Olympic Arms PCR;

`(iv) AR70;

`(v) Calico Liberty;

`(vi) Dragunov SVD Sniper Rifle or Dragunov SVU;

`(vii) Fabrique National FN/FAL, FN/LAR, or FNC;

`(viii) Hi-Point Carbine;

`(ix) HK-91, HK-93, HK-94, or HK-PSG-1;

`(x) Kel-Tec Sub Rifle;

`(xi) M1 Carbine;

`(xii) Saiga;

`(xiii) SAR-8, SAR-4800;

`(xiv) SKS with detachable magazine;

`(xv) SLG 95;

`(xvi) SLR 95 or 96;

`(xvii) Steyr AUG;

`(xviii) Sturm, Ruger Mini-14;

`(xix) Tavor;

`(xx) Thompson 1927, Thompson M1, or Thompson 1927 Commando; or

`(xxi) Uzi, Galil and Uzi Sporter, Galil Sporter, or Galil Sniper Rifle (Galatz).

`(B) The following pistols or copies or duplicates thereof:

`(i) Calico M-110;

`(ii) MAC-10, MAC-11, or MPA3;

`(iii) Olympic Arms OA;

`(iv) TEC-9, TEC-DC9, TEC-22 Scorpion, or AB-10; or

`(v) Uzi.

`(C) The following shotguns or copies or duplicates thereof:

`(i) Armscor 30 BG;

`(ii) SPAS 12 or LAW 12;

`(iii) Striker 12; or

`(iv) Streetsweeper.

`(D) A semiautomatic rifle that has an ability to accept a detachable magazine, and that has--

`(i) a folding or telescoping stock;

`(ii) a threaded barrel;

`(iii) a pistol grip;

`(iv) a forward grip; or

`(v) a barrel shroud.

`(E)(i) Except as provided in clause (ii), a semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds.

`(ii) Clause (i) shall not apply to an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.

`(F) A semiautomatic pistol that has the ability to accept a detachable magazine, and has--

`(i) a second pistol grip;

`(ii) a threaded barrel;

`(iii) a barrel shroud; or

`(iv) the capacity to accept a detachable magazine at a location outside of the pistol grip.

`(G) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.

`(H) A semiautomatic shotgun that has--

`(i) a folding or telescoping stock;

`(ii) a pistol grip;

`(iii) the ability to accept a detachable magazine; or

`(iv) a fixed magazine capacity of more than 5 rounds.

`(I) A shotgun with a revolving cylinder.

`(J) A frame or receiver that is identical to, or based substantially on the frame or receiver of, a firearm described in any of subparagraphs (A) through (I) or (L).

`(K) A conversion kit.

`(L) A semiautomatic rifle or shotgun originally designed for military or law enforcement use, or a firearm based on the design of such a firearm, that is not particularly suitable for sporting purposes, as determined by the Attorney General. In making the determination, there shall be a rebuttable presumption that a firearm procured for use by the United States military or any Federal law enforcement agency is not particularly suitable for sporting purposes, and a firearm shall not be determined to be particularly suitable for sporting purposes solely because the firearm is suitable for use in a sporting event.'.

(b) Related Definitions- Section 921(a) of such title is amended by adding at the end the following:

`(36) Barrel Shroud- The term `barrel shroud' means a shroud that is attached to, or partially or completely encircles, the barrel of a firearm so that the shroud protects the user of the firearm from heat generated by the barrel, but does not include a slide that encloses the barrel, and does not include an extension of the stock along the bottom of the barrel which does not encircle or substantially encircle the barrel.

`(37) Conversion Kit- The term `conversion kit' means any part or combination of parts designed and intended for use in converting a firearm into a semiautomatic assault weapon, and any combination of parts from which a semiautomatic assault weapon can be assembled if the parts are in the possession or under the control of a person.

`(38) Detachable Magazine- The term `detachable magazine' means an ammunition feeding device that can readily be inserted into a firearm.

`(39) Fixed Magazine- The term `fixed magazine' means an ammunition feeding device contained in, or permanently attached to, a firearm.

`(40) Folding or Telescoping Stock- The term `folding or telescoping stock' means a stock that folds, telescopes, or otherwise operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability, of a firearm.

`(41) Forward Grip- The term `forward grip' means a grip located forward of the trigger that functions as a pistol grip.

`(42) Pistol Grip- The term `pistol grip' means a grip, a thumbhole stock, or any other characteristic that can function as a grip.

`(43) Threaded Barrel- The term `threaded barrel' means a feature or characteristic that is designed in such a manner to allow for the attachment of a firearm as defined in section 5845(a) of the National Firearms Act (26 U.S.C. 5845(a)).'.

SEC. 4. GRANDFATHER PROVISION.

Section 922(v)(2) of title 18, United States Code, as added by section 2(a) of this Act, is amended--

(1) by inserting `(A)' after `(2)'; and

(2) by adding after and below the end the following:

`(B) Paragraph (1) shall not apply to any firearm the possession or transfer of which would (but for this subparagraph) be unlawful by reason of this subsection, and which is otherwise lawfully possessed on the date of the enactment of this subparagraph.'.

SEC. 5. REPEAL OF CERTAIN EXEMPTIONS.

Section 922(v)(3) of title 18, United States Code, as added by section 2(a) of this Act, is amended by striking `(3)' and all that follows through the 1st sentence and inserting the following:

`(3) Paragraph (1) shall not apply to any firearm that--

`(A) is manually operated by bolt, pump, level, or slide action;

`(B) has been rendered permanently inoperable; or

`(C) is an antique firearm.'.

SEC. 6. REQUIRING BACKGROUND CHECKS FOR THE TRANSFER OF LAWFULLY POSSESSED SEMIAUTOMATIC ASSAULT WEAPONS.

Section 922(v) of title 18, United States Code, as added by section 2(a) of this Act, is amended by adding at the end the following:

`(5) It shall be unlawful for any person to transfer a semiautomatic assault weapon to which paragraph (1) does not apply, except through--

`(A) a licensed dealer, and for purposes of subsection (t) in the case of such a transfer, the weapon shall be considered to be transferred from the business inventory of the licensed dealer and the dealer shall be considered to be the transferor; or

`(B) a State or local law enforcement agency if the transfer is made in accordance with the procedures provided for in subsection (t) of this section and section 923(g).

`(6) The Attorney General shall establish and maintain, in a timely manner, a record of the make, model, and date of manufacture of any semiautomatic assault weapon which the Attorney General is made aware has been used in relation to a crime under Federal or State law, and the nature and circumstances of the crime involved, including the outcome of relevant criminal investigations and proceedings. The Attorney General shall annually submit the record to the Congress and make the record available to the general public.'.

SEC. 7. STRENGTHENING THE BAN ON THE POSSESSION OR TRANSFER OF A LARGE CAPACITY AMMUNITION FEEDING DEVICE.

(a) Ban on Transfer of Semiautomatic Assault Weapon With Large Capacity Ammunition Feeding Device-

(1) IN GENERAL- Section 922 of title 18, United States Code, is amended by inserting after subsection (y) the following:

`(z) It shall be unlawful for any person to transfer any assault weapon with a large capacity ammunition feeding device.'.

(2) PENALTIES- Section 924(a) of such title is amended by adding at the end the following:

Carolyn McCarthy, whose husband, Dennis McCarthy, was killed by Ferguson, and whose son, Kevin McCarthy, was severely injured, was subsequently elected to the United States Congress on a platform of gun control. The Death of Her Parents

On Wednesday, October 16, 1991, Hupp and her parents were having lunch at the Luby's in Killeen. She had left her handgun in her car to comply with Texas state law at the time which forbade carrying a concealed weapon. When George Hennard drove his truck into the cafeteria and opened fire on the patrons, Hupp instinctively reached into her purse for her weapon, but it was in her vehicle. Her father, Al Gratia, tried to rush Hennard and was shot in the chest. As the gunman reloaded, Hupp escaped through a broken window and believed that her mother, Ursula Gratia, was behind her. Hennard put a gun to her mother's head as she cradled her mortally wounded husband. Hupp's mother and father were killed along with twenty-one other persons. Hennard also wounded some twenty others. As a survivor of the Luby's massacre, Hupp testified across the country in support of concealed-handgun laws. She said that had there been a second chance to prevent the slaughter, she would have violated the Texas law and carried the handgun inside her purse into the restaurant.

MILWAUKEE – Sen. Barack Obama this morning commented on Thursday's shootings at Northern Illinois University, as he also discussed his views on gun laws.

Before speaking to a rally here, Obama said the nation must do a "more effective job of enforcing our gun laws, strengthening our background check system, being able to trace guns that are used in violent crimes to unscrupulous gun dealers -- so that we can crack down on them -- closing gun show loopholes."

He specifically pointed to a California law as a possible model.

"There was a discussion today about a law that has just passed in California that allows micro-tracing of bullets that have been discharged in a crime so that they can immediately be traced," he said. "This is something that California has passed over the strong objections of the NRA…That's the kind of common sense gun law that gun owners as well as victims of gun violence can get behind."

Obama said he believes in the Second Amendment, but that there is plenty of room for added gun regulations. "There is an individual right to bear arms, but it's subject to commonsense regulation," he said.

Mentioning his home city, Obama said local entities should also have the ability to have their own more strict regulations.

"I think that local jurisdictions have the capacity to institute their own gun laws…The City of Chicago has gun laws, as does Washington, D.C.," he said. "I think the notion that somehow local jurisdictions can't initiate gun safety laws to deal with gang-bangers and random shootings on the street isn't born out by our Constitution."

Concealed Carry OK for Retired Police Officers

Obama voted for a bill in the Illinois senate that allowed retired law enforcement officers to carry concealed weapons. If there was any issue on which Obama rarely deviated, it was gun control. He was the most strident candidate when it came to enforcin and expanding gun control laws. So this vote jumped out as inconsistent.

When I queried him about the vote, he said, "I didn't find that [vote] surprising. I am consistently on record and will continue to be on record as opposing concealed carry. This was a narrow exception in an exceptional circumstance where a retired police officer might find himself vulnerable as a consequence of the work he has previously done--and had been trained extensively in the proper use of firearms."

It wasn't until a few weeks later that another theory came forward about the uncharacteristic vote. Obama was battling with his GOP opponent to win the endorsement of the Fraternal Order of Police.

Exemptions from Code Sections 16-11-126 through 16-11-128


(a) Code Sections 16-11-126 through 16-11-128 shall not apply to or affect any of the following persons if such persons are employed in the offices listed below or when authorized by federal or state law, regulations, or order:

(1) Peace officers, as such term is defined in paragraph (11) of Code Section 16-1-3, and retired peace officers so long as they remain certified whether employed by the state or a political subdivision of the state or another state or a political subdivision of another state but only if such other state provides a similar privilege for the peace officers of this state;

(2) Wardens, superintendents, and keepers of correctional institutions, jails, or other institutions for the detention of persons accused or convicted of an offense;

(3) Persons in the military service of the state or of the United States;

(4) Persons employed in fulfilling defense contracts with the government of the United States or agencies thereof when possession of the weapon is necessary for manufacture, transport, installation, and testing under the requirements of such contract;

(5) District attorneys, investigators employed by and assigned to a district attorney's office, assistant district attorneys, attorneys or investigators employed by the Prosecuting Attorneys' Council of the State of Georgia, and any retired district attorney, assistant district attorney, district attorneys investigator, or attorney or investigator retired from the Prosecuting Attorneys' Council of the State of Georgia, if such employee is retired in good standing and is receiving benefits under Title 47 or is retired in good standing and receiving benefits from a county or municipal retirement system;

(6) State court solicitors-general; investigators employed by and assigned to a state court solicitor-general's office; assistant state court solicitors-general; the corresponding personnel of any city court expressly continued in existence as a city court pursuant to Article VI, Section X, Paragraph I, subparagraph (5) of the Constitution; and the corresponding personnel of any civil court expressly continued as a civil court pursuant to said provision of the Constitution;

(7) Those employees of the State Board of Pardons and Paroles when specifically designated and authorized in writing by the members of the State Board of Pardons and Paroles to carry a weapon;

(8) The Attorney General and those members of his or her staff whom he or she specifically authorizes in writing to carry a weapon;

(9) Chief probation officers, probation officers, intensive probation officers, and surveillance officers employed by and under the authority of the Department of Corrections pursuant to Article 2 of Chapter 8 of Title 42, known as the "State-wide Probation Act," when specifically designated and authorized in writing by the director of Division of Probation;

(10) Public safety directors of municipal corporations;

(11) Explosive ordnance disposal technicians, as such term is defined by Code Section 16-7-80, and persons certified as provided in Code Section 35-8-13 to handle animals trained to detect explosives, while in the performance of their duties;

(12) State and federal trial and appellate judges, full-time and permanent part-time judges of municipal and city courts, and former state trial and appellate judges retired from their respective offices under state retirement;

(13) United States Attorneys and Assistant United States Attorneys;

(14) County medical examiners and coroners and their sworn officers employed by county government; and

(15) Clerks of the superior courts.

(b) Code Sections 16-11-126 through 16-11-128 shall not apply to or affect persons who at the time of their retirement from service with the Department of Corrections were chief probation officers, probation officers, intensive probation officers, or surveillance officers, when specifically designated and authorized in writing by the director of Division of Probation.

(c) Code Sections 16-11-126 through 16-11-128 shall not apply to or affect any:

(1) Sheriff, retired sheriff, deputy sheriff, or retired deputy sheriff if such retired deputy sheriff is receiving benefits under the Peace Officers' Annuity and Benefit Fund provided under Chapter 17 of Title 47;

(2) Member of the Georgia State Patrol or agent of the Georgia Bureau of Investigation or retired member of the Georgia State Patrol or agent of the Georgia Bureau of Investigation if such retired member or agent is receiving benefits under the Employees' Retirement System;

(3) Full-time law enforcement chief executive engaging in the management of a county, municipal, state, state authority, or federal law enforcement agency in the State of Georgia, including any college or university law enforcement chief executive that is registered or certified by the Georgia Peace Officer Standards and Training Council; or retired law enforcement chief executive that formerly managed a county, municipal, state, state authority, or federal law enforcement agency in the State of Georgia, including any college or university law enforcement chief executive that was registered or certified at the time of his or her retirement by the Georgia Peace Officer Standards and Training Council, if such retired law enforcement chief executive is receiving benefits under the Peace Officers' Annuity and Benefit Fund provided under Chapter 17 of Title 47 or is retired in good standing and receiving benefits from a county, municipal, State of Georgia, state authority, or federal retirement system; or

(4) Police officer of any county, municipal, state, state authority, or federal law enforcement agency in the State of Georgia, including any college or university police officer that is registered or certified by the Georgia Peace Officer Standards and Training Council, or retired police officer of any county, municipal, state, state authority, or federal law enforcement agency in the State of Georgia, including any college or university police officer that was registered or certified at the time of his or her retirement by the Georgia Peace Officer Standards and Training Council, if such retired employee is receiving benefits under the Peace Officers' Annuity and Benefit Fund provided under Chapter 17 of Title 47 or is retired in good standing and receiving benefits from a county, municipal, State of Georgia, state authority, or federal retirement system.

In addition, any such sheriff, retired sheriff, deputy sheriff, retired deputy sheriff, active or retired law enforcement chief executive, or other law enforcement officer referred to in this subsection shall be authorized to carry a pistol or revolver on or off duty anywhere within the state and the provisions of Code Sections 16-11-126 through 16-11-128 shall not apply to the carrying of such firearms.

(d) A prosecution based upon a violation of Code Section 16-11-126, 16-11-127, or 16-11-128 need not negative any exemptions.
