A month after the shootings, Cabey's lawyers William Kunstler and Ron Kuby filed a civil suit against Goetz.The case was tried in 1996, eleven years later, in The Bronx, with race as the dominant theme. During jury selection, Kuby asked the mostly non-white prospective jurors whether they had ever been discriminated against. Goetz admitted to previous use of racial language and to smoking marijuana laced with angel dust in the 1980s. Kuby portrayed Goetz as a racist aggressor; Goetz's defense was that when surrounded he reacted in fear of being again robbed and beaten. Newspaper columnist Jimmy Breslin testified that in a 1985 interview, Cabey denied his involvement in an attempted robbery, but said that Canty, Allen, and Ramseur intended to rob Goetz.
The jury of four blacks and two Hispanics found that Goetz had acted recklessly and had deliberately inflicted emotional distress on Cabey.Jurors interviewed after the trial said that Goetz's decision to fire at Cabey a second time was a key factor in their decision.[56] The jury awarded Cabey $43 million – $18 million for pain and suffering and $25 million in punitive damages.
Goetz subsequently filed for bankruptcy, saying that legal expenses had left him almost penniless. A judge of the United States Bankruptcy Court ruled that the $43 million jury award could not be dismissed by the bankruptcy.Asked in 2004 whether he was making payments on the judgment, Goetz responded "I don't think I've paid a penny on that", and referred any questions on the subject to his attorney.

"Crimes; person who is attacked has no duty to retreat; provide immunity from prosecution"

By the way; This Law has nothing to do with your Rights to Bear Arms. The Castle Law allows us the right to exercise our rights to self protection without suffering the aftermaths of legal consequences.

For those who don't know Gail; She is my State Senator and at one time, she was one of our State Representatives in Clayton County, when The Castle Law came up in our Georgia General Assembly in -2006

Gail Buckner : That is correct. I was re-elected to the Georgia House for the 2005 - 06 term with almost 91 percent of the vote. I voted against SB 396 because it is already legal for persons to protect themselves. Police officers asked me to vote against this bill becuase they were concerned that bill went too far and would put their lives in danger. I have also found high ratings from the NRA, but I approach every billl with a new perspective on what is best for our citizens. 770-473-9039

If anyone is wondering about how I ended up, talking about Georgia's Castle Law, in the same topic as the case of Bernard Goetz, allow me to explain.

Georgia's Castle Law : SB 396

"A person who is justified in threatening or using force against another under the provisions of Code Section 16-3-21, relating to the use of force in defense of self or others, Code Section 16-3-23, relating to the use of force in defense of a habitation, or Code Section 16-3-24, relating to the use of force in defense of property other than a habitation, has no duty to retreat from the use of such force and shall not be held liable to the person against whom the use of force was justified or to any person acting as an accomplice or assistant to such person in any civil action brought as a result of the threat or use of such force."

Bernard Goetz faced a Civil Trial after he survived a Criminal Trial.

Before this Bill was introduced in the Georgia Legislature; Citizens was willing victims of crime and they was at the mercy of their predators.

Those who strongly opposed this law, was liberals of the democrat party of our State. Many of those was either Black or Whites that catered to the NAACP, SCLC, and other Black Organizations in the Metropolitan Area of Atlanta, Ga. This was the reasoning behind my inquisitions with my so called State Senator.

In October 2005 the Florida became the first state in the United States to officially put a “Castle Doctrine” law on its books. Supporters hailed it as a “stand your ground” law while opponents called it a “shoot to kill” license.

The “Castle Doctrine” is an American legal concept inherited from English common law which extends to a homeowner (or one’s place of residence) the natural right to use deadly force to defend his home/residence in response to a violent attack or an intrusion that may lead to a violent attack. Some states have extended this right to any “legally occupied” place such as a vehicle, business, or place of work.

Twenty states, including Texas, have followed Florida’s lead – all of whom were heavily lobbied by the National Rifle Association – in enacting Castle Doctrine laws. These states differ in varying ways on what degree of retreat or non-deadly resistance is required before a person can use deadly force in a legally justifiable manner.

Hupp is recognized as a leading advocate for the Second Amendment and an individual's right to carry a concealed weapon.

She is a former Republican member of the Texas House of Representatives, who represented traditionally Democratic District 54 (Bell, Burnet, and Lampasas counties) for ten years from 1997-2007.

She was elected to her first term in 1996 but did not seek a sixth two-year term in 2006.

The Death of Her Parents

On Wednesday, October 16, 1991, Hupp and her parents were having lunch at the Luby's in Killeen. She had left her handgun in her car to comply with Texas state law at the time which forbade carrying a concealed weapon. When George Hennard drove his truck into the cafeteria and opened fire on the patrons, Hupp instinctively reached into her purse for her weapon, but it was in her vehicle. Her father, Al Gratia, tried to rush Hennard and was shot in the chest. As the gunman reloaded, Hupp escaped through a broken window and believed that her mother, Ursula Gratia, was behind her. Hennard put a gun to her mother's head as she cradled her mortally wounded husband. Hupp's mother and father were killed along with twenty-one other persons. Hennard also wounded some twenty others. As a survivor of the Luby's massacre, Hupp testified across the country in support of concealed-handgun laws. She said that had there been a second chance to prevent the slaughter, she would have violated the Texas law and carried the handgun inside her purse into the restaurant.

LAMPASAS -- Suzanna Gratia Hupp remembers reaching for a butter knife as a madman shot her parents dead at a packed cafeteria one cold October day in 1991.

"I was looking for a weapon, any weapon, because my handgun was 100 feet away, outside in my car. I made an incredibly stupid decision to follow the law, and that cost my family's lives," she says as she reflects on the massacre that ended with 24 people dead inside the Luby's Cafeteria at Killeen, a military town in Central Texas.

The personal tragedy launched her one-woman crusade to permit licensed owners to carry concealed weapons.

Texas lawmakers listened. In January 1996, a law took effect allowing Texans to carry loaded handguns if they obtain a license and complete a safety course.

"A gun is not a guarantee, it simply changes the odds," says Hupp, 37, who rode her campaign to a seat in the Texas Legislature.
